General

These terms of use (together with the documents referred to in it) tell you the terms on which you may make use as a guest user of our series of destination websites, including this website, which are connected under the SeeTheWorld (STW) group (our sites). 

Use of our sites includes accessing or browsing our sites.  Where you have registered to use our sites and are logged in as a registered user, the Terms of Use of Our Sites for Registered Users will apply to your use of our sites and these terms of use will not apply to your use of our sites. 

Please read these terms of use carefully before you start to use our sites, as these will apply to your use of our sites. We recommend that you print a copy of these terms of use for future reference.

By using our sites you agree to abide by the terms of use detailed below. If you do not agree with our terms of use please do not use our sites.

These terms of use incorporate the following policies, which also apply to your use of our sites:

  • our Cookie Policy (set out below), which provides information about the cookies on our sites; and
  • our Privacy Policy (set out below), which sets out the terms on which we process any personal data we collect from you, or that you provide to us. By using our sites, you consent to such processing and you warrant that all data provided by you is accurate.

If you book services through our sites, our Booking & Financial Terms for Customers will apply to the relationship between you and us as booking agent for the accommodation providers and other service providers advertised on our sites.

The references to ‘us’, ‘we’, ‘our’, ‘ours’, ‘the Company’ are references to Powder Blue Limited, trading as SeeTheWorld, who owns and operates our sites.  We are registered in England and Wales under company registration number 3186762 and have our registered office at Bridgetts Farm Offices, Bridgetts Lane, Martyr Worthy, Winchester, Hampshire SO21 1AR, United Kingdom. Our main trading address is Number 3 Bridgetts Farm Offices, Bridgetts Lane, Martyr Worthy, Hampshire SO21 1AR, United Kingdom.  Our VAT number is GB796 0384 92.

Changes to These Terms
We may at any time and without prior notice change these terms of use and your continued use of our sites implies that you agree with such terms of use which apply at the time of your use. Please check this page from time to time to take notice of any changes we have made, as they are binding on you. 

If you are a consumer, please note that these terms of use, their subject matter and their formation are governed by English law. You and we both agree that the courts of England and Wales will have non-exclusive jurisdiction. However, if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.

If you are a business, these terms of use, their subject matter and their formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.

Our Sites

Through our sites, we provide an online platform through which you may browse, learn about and book services directly with Service Providers (hereinafter defined).  Service Providers means third parties who advertise and list their services via our sites (Service Providers).  We act as a booking agent only in respect of bookings we make on your behalf with Service Providers.  By booking services on our sites, you will be entering into a contractual relationship with Service Provider(s) and we act solely as an intermediary and agent.

You accept that we have not in any way selected or assembled your travel arrangements for you.  Your accommodation arrangements are not a package and do not fall within the meaning of The Package Travel, Package Holidays and Package Tours Regulations 1992.

By proceeding to book services through our sites, you accept that you will be entering into a contract with the Service Provider on their standard terms and conditions.

Information on our sites is managed by us. Contributions and advertisements are also posted by third parties including Service Providers. We may update our sites from time to time and may change the content at any time.

Any details, prices, timetables or any other information relating to details of offers on our sites should only be considered indicative until such time as you have received written confirmation from the Service Provider operating the service or from us on behalf of the Service Provider.

Whilst we include hyperlinks and references to services and products from third parties for your convenience, we cannot be responsible for any materials on those sites. Any opinions, advice or advertisements on our sites are for your informational purposes only and do not constitute an endorsement of them.

The content on our sites is provided for general information only. It is not intended to amount to advice on which you should rely.

Accessing Our Sites
Our sites are made available free of charge.

We do not guarantee that our sites, or any content on it, will always be available or be uninterrupted. Access to our sites is permitted on a temporary basis. We may suspend, withdraw, discontinue or change all or any part of our sites without notice. We will not be liable to you if for any reason our sites are unavailable at any time or for any period.

You are responsible for making all arrangements necessary for you to have access to our sites.

You are also responsible for ensuring that all persons who access our sites through your internet connection are aware of these terms of use and that they comply with them.

Intellectual Property Rights
All rights to or in our sites are reserved. Unless otherwise stated, we own (or are licensed or have permission to use) the intellectual property rights in our sites, in the content on our sites and in the material published on it. Information, texts, photographs, designs, documents, any other material on our sites, or any intellectual property relating to our sites, its content or in the material published on it, may not be used commercially by you or transferred to a third party by you. You may not reprint, translate, rent, sub-license, copy, modify, publish, sell, or distribute any part of our sites, its content or the material published on it, without our prior written consent. You may not derive or attempt to derive the source code of our sites. You are welcome to print one copy, and may download extracts, of any page(s) of our sites for your personal use, except where the credit is not exclusively/explicitly one of our sites or us and therefore where other permissions may be required by prior written consent.

If you print off, copy or download any part of our sites in breach of these terms of use, your right to use our sites will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

Liability

Nothing in these terms of use excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to our sites or any content on it, whether express or implied.

We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

  • use of, or inability to use, our sites;
  • failure to access or delay in accessing our sites;
  • use of or reliance on any content displayed or available on our sites or through our sites; or
  • the performance or non-performance of any third party providers including Service Providers listed on or connected to our sites.

If you are a business user, please note that in particular, we will not be liable for:

  • loss of profits, sales, business, or revenue;
  • business interruption;
  • loss of anticipated savings;
  • loss of business opportunity, goodwill or reputation; or
  • any indirect or consequential loss or damage.

If you are a consumer, please note that we only provide our sites for domestic and private use. You agree not to use our sites for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our sites or to your downloading of any content on it, or on any websites linked to it.

Our sites are provided on an 'as is' basis.  No guarantees, warranties or representations of any kind whether expressed or implied, are given in connection with our sites, or its content, including that it is accurate, complete or up to date or free from errors or omissions. We cannot be held responsible for any errors or omissions or for any loss, injury or inconvenience sustained by anyone using our sites, or the content on it, whether posted by us or by a third party including Service Providers, or in any other correspondence from us or from a third party including Service Providers.

We assume no responsibility for the content of external websites linked to or from our sites. Such links should not be interpreted as endorsement by us of those linked websites. We will not be liable for any loss or damage that may arise from your use of them.

We make no guarantees, express or implied, of the standards of service or quality of the products listed within our sites. Unless otherwise stated, any purchases made from a third party included on our sites including Service Providers, and any subsequent enquiries, bookings or contracts will be subject to separate terms and conditions between you and the Service Provider or operator of the service or product purchased. You should contact the Service Provider or operator of such services or products for a copy of their terms and conditions and any restrictions which may apply.

When making a booking with a third party including Service Providers, be advised that this is usually only valid once confirmed in writing by the Service Provider or operator you have contacted. Fares are not guaranteed until tickets are confirmed and purchased and details may be subject to change as should be detailed in separate terms and conditions from the Service Provider or operator of the service or product purchased.

Where you have contacted us with regards a third party including any Service Providers we shall make no guarantees, express or implied, of the completeness or accuracy of the information in any reply, nor that we shall be able to respond to, or forward to the relevant parties, enquires made by you. We shall, however, endeavor to address notifications of omissions or errors either made by us or by a third party including Service Providers and to forward relevant information to any relevant parties.

Your Contributions

To the extent that our sites allows you to post, upload, transmit or otherwise make available any information, posts, images, video, logos, advertisements, photographs, or other data on our sites or with us or other users of our sites (User Content), you agree that:

  1. you are solely responsible for the User Content that you upload and you represent and agree that you will not share anything which you do not have the permission or right to share and which you cannot grant the licence referred to in paragraph (b) below in respect of;
  2. although all intellectual property rights subsisting in any User Content will be owned by you or your licensors, you hereby grant us and our group companies a non-exclusive, perpetual, royalty-free, worldwide, transferrable and sub-licensable right to use, reproduce both electronically and otherwise, display, distribute, modify, adapt, publish, translate, and create derivative works from any and all such User Content (excluding personally identifiable information) including for the purposes of advertising and marketing our sites and our services; and
  3. we are under no obligation to store, retain, publish or make available any User Content uploaded by you and that you shall be responsible for creating backups of any such User Content if necessary.

You agree that any User Content that you upload will be constructive and polite, that any User Content that you upload and any usernames you use are not in any way unlawful, harassing, defamatory, abusive, threatening, obscene, profane, sexually orientated, or racially offensive. You agree to only submit User Content which does not infringe the rights of third parties, including any intellectual property rights, rights of privacy or rights of confidentiality.

We reserve the right to take action against you including restricting your access to our sites or services, or informing relevant authorities of your actions if in our opinion, the User Content uploaded by you does not comply with these terms of use.

If any section of these terms of use is declared invalid, unlawful, or unenforceable the remaining sections shall remain in full effect.

Viruses

We do not guarantee that our sites will be secure or free from bugs or viruses.

You are responsible for configuring your information technology, computer programmes and platform in order to access our sites. You should use your own virus protection software.

You must not misuse our sites by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our sites, the server on which our sites are stored or any server, computer or database connected to our sites. You must not attack our sites via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our sites will cease immediately.

Further Information & Advice

You should not reveal any personal information about yourself, such as your address, credit card details, telephone number, on the internet or via email unless you are certain that it is safe to do so and that any confidential or private information you share over the internet is sent by secure encryption means.

It is always your responsibility to ensure full compliance with any passport, visa, and inoculation requirements as governed either by your country of residence or by those you will be travelling to.

Be advised that various consumer protection schemes and laws relating to travel and tourism companies exist for your financial protection and that it is in your interests to be aware of such schemes.

You should always ensure that you have obtained sufficient insurance cover, either via your own policy or through that of any Service Provider, event organiser or operator, appropriate to the activities you will be participating in and you should carry details of this on you at all times. Details of insurance providers you may wish to obtain services from may be found on our sites.

Cookies

We use cookies to ensure that we give you the best experience on our sites and to show you essential advertising, without which our sites could not be funded and would cease to exist. We also use tools and content from third parties to improve sharing, commenting and other functionality.  By continuing to browse our sites, you are agreeing to our use of cookies on our sites.

This policy (together with the terms of use and the Cookie Policy) sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us where you use our sites as a guest user.  Where you have registered to use our sites, Terms of Use of Our Sites for Registered Users will apply to the processing of any personal data we collect from you, or that you provide to us.

Personal data means information that relates to a living individual who can be identified from that information or from that information together with other information which is held by or likely to be held by us (personal data).

INFORMATION WE MAY COLLECT FROM YOU

We may collect and process the following personal data about you:

  • Information you give us. You may give us information about you:
    • by filling in enquiry forms on our sites or by corresponding with us by phone, e-mail or otherwise;
    • when you participate in discussion boards or other social media functions on our sites, enter a competition, promotion or survey and when you report a problem with our sites; and
    • when you provide information to us for the purpose of subscribing to and to news and/or weather alerts through any of our sites.

Disclosure of Your Information
We may share your personal data with any member of our group, which means our subsidiaries, our ultimate holding company and its subsidiaries, as defined in section 1159 of the Companies Act 2006 in accordance with this policy and for the purposes set out above.

We may share your information with selected third parties to process your information on our behalf including:

  • Business partners, suppliers, sub-contractors and Service Providers for the performance of any contract we enter into with them or you;
  • Advertisers and advertising networks that require the data to select and serve relevant adverts to you and others. We do not disclose information about identifiable individuals to our advertisers, but we may provide them with aggregate information about our users (for example, we may inform them that 500 men aged under 30 have clicked on their advertisement on any given day). We may also use such aggregated information to help advertisers reach the kind of audience they want to target (for example, women in SW1). We may make use of the personal data we have collected from you to enable us to comply with our advertisers' wishes by displaying their advertisement to that target audience; and
  • Analytics and search engine providers that assist us in the improvement and optimisation of our sites.

We may disclose your personal information to third parties:

  • In the event that we sell or buy any business or assets, in which case we may disclose your personal data to the prospective seller or buyer of such business or assets;
  • If Powder Blue Limited or substantially all of our assets are acquired by a third party, in which case personal data held by us about our customers will be one of the transferred assets;
  • If we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply our terms of use and other agreements; and
  • To protect the rights, property, or safety of Powder Blue Limited, our customers or others. This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction.

Where we Store your Personal Data
The data that we collect from you may be transferred to, and stored at, a destination outside the European Economic Area (EEA). It may also be processed by staff operating outside the EEA who work for us or for one of our suppliers. Such staff maybe engaged in, among other things, the processing of your payment details and the provision of support services. By submitting your personal data, you agree to this transfer, storing or processing. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this privacy policy.

All information you provide to us is stored on our secure servers.

Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our sites; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.

Access to Information
The General Data Protection Regulation (GDPR) (EU) gives you the right to access information held about you. Your right of access can be exercised in accordance with that Act. Any access request may be subject to a fee of £10 to meet our costs in providing you with details of the information we hold about you.

Any changes we may make to our privacy policy in the future will be posted on this page and, where appropriate, notified to you by e-mail. Please check back frequently to see any updates or changes to our privacy policy.

Local Business' Contributions

We charge a fee or commission to local businesses who want us to update their details, photos, events, offers and/or their presentation in our system; some take additional promotional banners on our sites to better promote their products and/or their services. These contributions help to cover some of the costs of operating our sites, developing the software, salaries, hardware, paying the electricity, cars/travel and more...
